Introduction
This Privacy Policy explains, and constitutes your binding consent to, how ParkAI, Inc. ("ParkAI," "we," "our," or "us") collects, uses, retains, discloses, and otherwise processes data through the ParkAI website, mobile app, kiosks, and camera- and sensor-based enforcement systems (collectively, the "Services"). By accessing or using the Services — including by parking in an area where ParkAI's automated enforcement operates, whether or not you have an account — you consent to the collection and processing of your data as described in this Policy. If you do not consent, do not use the Services, and do not park in an area posted as monitored by ParkAI enforcement.
1. Data We Collect
We collect, without limitation: (a) information you provide, including name, phone number, email address, payment information, and vehicle/license plate data; (b) LPR Data, meaning images of license plates and incidentally captured vehicle images, collected by fixed or mobile cameras in any area where a Municipal Client has deployed ParkAI enforcement, regardless of whether the vehicle's registrant has a ParkAI account or has consented individually — presence in a monitored area is itself sufficient basis for collection; (c) transaction, session, and location data; (d) device and technical identifiers; and (e) any data a Municipal Client, law enforcement agency, or other third party provides to us in connection with operating the Services.
2. Our Rights to Use Data
ParkAI may use all data described in Section 1 for any purpose reasonably related to operating, securing, protecting, defending, improving, and commercializing the Services and ParkAI's business, including: processing payments; operating and continuously improving our LPR and detection models (including by using your data, in de-identified or aggregated form, to train and refine ParkAI's technology generally, across all Municipal Clients and deployments); issuing and supporting automated citations; fraud and abuse prevention; enforcing these Terms and this Policy; complying with legal process; and defending ParkAI's legal interests, including in litigation with you or any third party. ParkAI's use of de-identified or aggregated data is not restricted by this Policy and may continue indefinitely and without further notice to you.
3. Disclosure of Data
A. Municipal Clients. We disclose payment, session, and LPR Data to the Municipal Client responsible for a given location as necessary for that client to issue and enforce citations; ParkAI bears no responsibility for a Municipal Client's own subsequent use, retention, or disclosure of that data once shared.
B. Service Providers and Corporate Transactions. We may disclose data to our service providers, contractors, and professional advisors, and to any successor, acquirer, or financing party in connection with a merger, acquisition, financing, reorganization, or sale of some or all of ParkAI's assets, without your further consent.
C. Legal Process and Protection of ParkAI. We may disclose data, including LPR Data, in response to any subpoena, warrant, court order, or governmental request, or where ParkAI determines in its sole discretion that disclosure is necessary to protect ParkAI's rights, property, personnel, or legal position, or the safety of any person, without prior notice to you.
D. No Sale of LPR Data for Advertising. ParkAI does not sell LPR Data for third-party behavioral advertising. This Policy does not otherwise restrict ParkAI's ability to license, share, or monetize de-identified or aggregated data derived from LPR Data or other data described in Section 1.
4. Text Messaging and Mobile Opt-In Data
If you provide a mobile phone number to ParkAI, you may receive text messages (SMS/MMS) related to your parking sessions, account, and citations, and, if you separately opt in, marketing messages. Text messaging originator opt-in data and consent — meaning your phone number and the fact and scope of your consent to receive text messages from ParkAI — is never shared with any third party or affiliate for marketing or promotional purposes, under any circumstance. This commitment applies notwithstanding Section 2 and Section 3 above, which govern other categories of data. Text messaging opt-in data and consent may be disclosed only: (a) to the messaging and telecommunications vendors ParkAI uses to deliver the messages themselves (for example, our SMS gateway provider); (b) where required by law or legal process; or (c) with your explicit, separate consent. You may opt out of any text messages at any time by replying STOP, which ParkAI will honor promptly.
5. Retention
ParkAI retains data, including LPR Data, for as long as ParkAI determines is reasonably necessary for the purposes described in this Policy, to defend or pursue any actual or potential legal claim, or to comply with a Municipal Client's retention requirements — whichever is longest. ParkAI is not obligated to delete data solely because a parking session has closed or a citation has been resolved, and may retain data derived from your use of the Services indefinitely in de-identified or aggregated form.
6. Security; No Warranty
ParkAI maintains administrative, technical, and physical safeguards it deems appropriate in its discretion. No security measure is guaranteed, and ParkAI disclaims all liability for unauthorized access, use, or disclosure of data except to the extent directly caused by ParkAI's own finally-adjudicated gross negligence, and even then subject to the limitations of liability in the Terms and Conditions, which are incorporated into this Policy by reference.
7. Your Choices
You may decline marketing communications at any time; this does not affect ParkAI's right to send transactional communications or to continue collecting, using, and disclosing your data for the purposes described in this Policy, which are a condition of using the Services rather than a matter of separate consent. Where applicable law grants you a right to know, access, correct, delete, or restrict processing of your data, you may submit a request using the contact information below; ParkAI will respond as required by applicable law and no more expansively, and may deny any request to the extent an exception applies, including where the data relates to an unresolved citation, a legal hold, or fraud investigation.
8. Children
The Services are not directed to anyone under eighteen (18). ParkAI does not knowingly collect data from children and will delete such data if discovered, without any admission of liability for its prior collection or use.
9. International Users
The Services are operated from, and all data is processed and stored in, the United States. By using the Services from any other jurisdiction, you consent to the transfer, processing, and storage of your data in the United States and agree that U.S. law governs any dispute concerning this Policy, as set out in the Terms and Conditions.
10. Changes to This Policy
ParkAI may revise this Policy at any time by posting the updated version on the Site, effective immediately upon posting. Your continued use of the Services after any revision constitutes your acceptance of the revised Policy. It is your sole responsibility to review this Policy periodically.
11. Contact Us
ParkAI is under no obligation to respond to any inquiry not required by applicable law.
